Terms & Conditions

Effective Date: September 11, 2026

These Terms & Conditions govern your use of the Frankly Her website, digital products, coaching services, assessments, and related materials offered by Frankly Her.

By accessing this website, purchasing a product, or using a Frankly Her service, you agree to these Terms & Conditions.

1. About Frankly Her

Frankly Her provides self-guided reflection tools, digital resources, assessments, coaching services, and related educational materials designed to support observation, reflection, and decision-making.

Frankly Her does not provide medical, psychological, legal, financial, or other licensed professional services.

2. Digital Products

Digital products, including The Gap Between, are provided for personal, individual use only.

You may not:

  • share login credentials or access codes with another person;

  • reproduce, copy, distribute, resell, sublicense, publish, or commercially exploit any Frankly Her product or material;

  • upload Frankly Her materials to shared drives, membership libraries, AI training datasets, course platforms, or other public or private repositories;

  • modify Frankly Her materials for resale or redistribution.

All intellectual property rights remain with Frankly Her unless expressly stated otherwise.

3. Account and Access

Some digital products require an email address, access code, or account authentication.

You are responsible for providing an accurate email address and maintaining access to that email account.

Access may be suspended or terminated if Frankly Her reasonably believes that access credentials have been shared, misused, or obtained improperly.

4. Purchases and Payment

Prices are displayed at the time of purchase and are subject to change.

Payment processing may be handled by third-party providers. Frankly Her does not directly store full payment card information.

A purchase is considered complete once the applicable payment or order confirmation has been successfully processed.

5. Refunds

Because digital products may provide immediate access to proprietary materials, digital purchases are generally non-refundable once access has been delivered, except where required by law.

If you experience a technical issue that prevents access to a purchased product, contact Frankly Her so the issue can be reviewed.

Coaching or service-specific cancellation and refund terms may be provided separately at the time of booking.

6. Coaching Services

Coaching services are intended to support reflection, decision-making, accountability, and personal development.

Coaching is not therapy, counseling, medical treatment, crisis support, or a substitute for services provided by a licensed mental health professional or other qualified professional.

Participation in coaching does not create a therapist-patient, attorney-client, physician-patient, fiduciary, or similar professional relationship.

7. Personal Responsibility

You remain responsible for your own decisions, actions, and outcomes.

Frankly Her does not guarantee any particular result from the use of its products, assessments, coaching services, or other materials.

You are responsible for deciding whether any information, question, exercise, or reflection practice is appropriate for your circumstances.

8. Intellectual Property

All Frankly Her content, including text, prompts, assessments, product names, graphics, frameworks, designs, downloads, digital interfaces, and related materials, is owned by or licensed to Frankly Her and is protected by applicable intellectual property laws.

“Frankly Her,” “The Gap Between,” and related branding, product names, and materials may not be used without permission.

9. Website and Service Availability

Frankly Her may update, modify, suspend, or discontinue any part of the website, digital products, or services at any time.

While reasonable efforts are made to maintain reliable access, uninterrupted or error-free availability is not guaranteed.

Temporary interruptions may occur because of maintenance, third-party services, internet conditions, hosting providers, authentication systems, or other technical issues.

10. Third-Party Services

Frankly Her may use third-party services for website hosting, payment processing, authentication, email delivery, data storage, scheduling, and other functions.

Your use of those services may also be subject to the third party’s own terms and privacy practices.

Frankly Her is not responsible for outages, errors, or conduct caused solely by third-party providers outside its reasonable control.

11. Prohibited Use

You may not use the Frankly Her website or products to:

  • violate applicable laws;

  • interfere with the website or its security;

  • attempt to gain unauthorized access to systems or accounts;

  • copy or extract proprietary content for commercial purposes;

  • impersonate another person;

  • misuse another purchaser’s access credentials.

12. Limitation of Liability

To the fullest extent permitted by law, Frankly Her will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the website, digital products, or services.

Frankly Her’s total liability relating to a specific purchase or service will not exceed the amount you paid for that purchase or service, except where applicable law requires otherwise.

13. Indemnification

You agree to hold Frankly Her harmless from claims, losses, liabilities, or expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

14. Privacy

Your use of Frankly Her is also subject to the Frankly Her Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, stored, and shared.

15. Changes to These Terms

Frankly Her may update these Terms & Conditions from time to time.

The updated version will be posted on this page with a revised effective date. Continued use of the website or services after an update constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
